1. About this policy

This Policy sets the rules for using Kampe. It applies to all Merchants, Customers, and visitors. Violations may result in suspension or termination of your account.

1.1. This Acceptable Use Policy ("Policy") sets out the rules for using the Kampe platform ("Platform"). It applies to all Merchants, Customers, and visitors.

1.2. The Platform is a tool for legitimate commerce. This Policy exists to protect Merchants, Customers, and the integrity of the Platform.

1.3. By using the Platform, you agree to comply with this Policy. Violations may result in suspension or termination of your account.

2. Prohibited activities

You may not use the Platform for fraud, money laundering, tax evasion, unauthorized access, data harvesting, fee circumvention, metric manipulation, spam, or any activity that violates Ugandan law.

2.1. You shall not use the Platform to:

(a) Commit fraud. This includes creating fake stores, listing goods you do not intend to deliver, collecting payments without fulfilling orders, identity theft, or impersonating another person or business.

(b) Launder money. Using the Platform to process payments for the purpose of disguising the origins of illegally obtained money is a criminal offence under the Anti-Money Laundering Act, 2013.

(c) Evade taxes. Using the Platform to conceal income, avoid VAT obligations, or otherwise evade tax is a violation of the Income Tax Act and the Value Added Tax Act.

(d) Gain unauthorised access. Attempting to access another user's account, the Platform's source code, databases, or servers without authorisation is an offence under Section 12 of the Computer Misuse Act, 2011.

(e) Disrupt the Platform. Introducing viruses, malware, denial-of-service attacks, or any other action intended to interfere with the Platform's operation.

(f) Harvest data. Collecting personal data of other users (Merchants or Customers) through automated means, scraping, or any method not authorised by us. This includes the use of robots, spiders, or other automated devices to monitor or copy any part of the Platform without our prior written permission.

(g) Circumvent fees. Directing Customers to pay outside the Platform to avoid transaction fees, or using any method to manipulate the fee structure.

(h) Manipulate reviews or metrics. Creating fake orders, inflating sales numbers, or posting false reviews.

(i) Send spam or unsolicited messages. Using the Platform or data obtained through the Platform to send unsolicited commercial communications.

(j) Violate any law of Uganda or any other jurisdiction in which you operate.

3. Prohibited content

You may not list, sell, or distribute counterfeit goods, stolen property, illegal drugs, weapons, pornographic material, content harmful to children, hate speech, IP-infringing goods, unlicensed financial products, tobacco or alcohol without proper licences, human body parts, or prohibited wildlife products.

3.1. You shall not list, sell, advertise, or distribute the following through the Platform:

(a) Counterfeit goods. Items that imitate a branded product without authorisation from the brand owner, in violation of the Trademarks Act, 2010.

(b) Stolen property. Goods obtained through theft, burglary, or fraud.

(c) Illegal drugs and controlled substances. Items prohibited under the National Drug Policy and Authority Act or any other applicable law.

(d) Weapons and ammunition. Firearms, explosives, knives designed as weapons, and military equipment, except where the Merchant holds a valid licence under the Firearms Act.

(e) Pornographic material. Content of a sexual nature, in violation of the Anti-Pornography Act, 2014.

(f) Content harmful to children. Any material that exploits, endangers, or depicts minors in a harmful or sexual manner. Sharing information relating to a child without parent or guardian authorisation is an offence under the Computer Misuse (Amendment) Act, 2022.

(g) Hate speech and content promoting violence. Material that promotes hatred based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic. This includes content that constitutes an offence under the Computer Misuse (Amendment) Act, 2022.

(h) Goods that infringe intellectual property. Items that copy or reproduce copyrighted material, patented designs, or trademarked branding without authorisation.

(i) Financial products and services. Securities, insurance, loans, or other regulated financial products unless the Merchant holds the required licence from the relevant regulatory authority (Bank of Uganda, Insurance Regulatory Authority, Capital Markets Authority).

(j) Tobacco and alcohol without the required licences under the Tobacco Control Act, 2015 and the Liquor Act.

(k) Human body parts or remains.

(l) Wildlife products prohibited under the Uganda Wildlife Act, 2019.

(m) Any other goods or services prohibited under the laws of Uganda.

4. Content standards

All content on the Platform must be accurate, truthful, and must not infringe intellectual property rights. Product images must depict the actual product being sold.

4.1. All content on the Platform (product descriptions, images, Store pages) must:

(a) Be accurate and not misleading, in compliance with the Competition and Consumer Protection Act, 2024;

(b) Not contain false claims about the origin, quality, or characteristics of products;

(c) Not impersonate another business or individual; and

(d) Not infringe the intellectual property rights of any third party.

4.2. Product images must depict the actual product being sold. Stock images are acceptable only if clearly labelled as representative.

5. Merchant obligations

Merchants must provide truthful information, keep details current, respond to customers, fulfil orders within stated timeframes, process returns properly, comply with tax obligations, and not operate multiple accounts to circumvent suspensions.

5.1. Merchants shall:

(a) Provide truthful and complete information about themselves and their business during registration;

(b) Keep their contact information and Mobile Money details current;

(c) Respond to Customer inquiries within a reasonable time;

(d) Fulfil orders within the timeframe stated on their Store or within thirty (30) days of order placement, whichever is earlier, in accordance with the Electronic Transactions Act, 2011;

(e) Process returns and refunds in accordance with their stated return policy and applicable law;

(f) Comply with all tax obligations, including registration with the Uganda Revenue Authority where required; and

(g) Not operate multiple accounts to circumvent a suspension or fee obligations.

6. Intellectual property complaints

If you believe content on the Platform infringes your intellectual property rights, send a written notice to support@kampestore.com. We will review and respond within seven days.

6.1. If you believe that content on the Platform infringes your intellectual property rights, send a written notice to support@kampestore.com containing:

(a) Your full name and contact details;

(b) A description of the intellectual property you claim is infringed;

(c) The Store name or URL of the infringing content on the Platform;

(d) A statement that you have a good-faith belief that the use is not authorised by the IP owner; and

(e) A declaration that the information in the notice is accurate.

6.2. We shall review the notice within seven (7) days and, if the claim is valid, remove or disable access to the infringing content.

6.3. We shall notify the Merchant whose content was removed and give them an opportunity to respond. If the Merchant provides a valid counter-notice, we may restore the content unless the complainant initiates legal proceedings.

7. Reporting violations

Report policy violations to support@kampestore.com. We will acknowledge reports within 48 hours and investigate within seven days.

7.1. If you become aware of content or activity on the Platform that violates this Policy, report it to us:

7.2. We shall acknowledge your report within forty-eight (48) hours and investigate within seven (7) days.

7.3. We may act on violations we discover ourselves, without a formal report.

7.4. Reports may be shared with law enforcement if required by law or if the reported activity constitutes a criminal offence.

8. Consequences of violations

Violations may result in warnings, content removal, store suspension, account termination, withheld payouts, or reporting to authorities. You may appeal any action within fourteen days.

8.1. If we determine that you have violated this Policy, we may take one or more of the following actions depending on the severity:

(a) Warning. A written notice specifying the violation and requesting that you stop the offending activity within a stated deadline.

(b) Content removal. Removing specific product listings, images, or Store content that violate this Policy.

(c) Store suspension. Temporarily suspending your Store while we investigate. During suspension, Customers cannot access your Store, but your data is preserved.

(d) Account termination. Permanently closing your account and removing your Store from the Platform. Termination follows the process in the Terms of Service and Merchant Agreement.

(e) Withholding payouts. Holding pending payouts if there is a reasonable suspicion of fraud or illegal activity, until the matter is resolved.

(f) Reporting to authorities. Referring the matter to the Uganda Police Force, Uganda Revenue Authority, Financial Intelligence Authority, or other relevant authority where the violation constitutes a criminal offence.

8.2. We shall notify you of any action taken and the reasons for it, except where doing so would compromise an ongoing investigation or endanger any person.

8.3. If you believe an action was taken in error, you may appeal by emailing support@kampestore.com within fourteen (14) days. We shall review your appeal and respond within fourteen (14) days.

9. Cooperation with authorities

We cooperate with law enforcement and regulatory authorities in Uganda, and may disclose your information when required by law or to prevent criminal activity.

9.1. We cooperate with law enforcement and regulatory authorities in Uganda, including the Uganda Police Force, the Uganda Revenue Authority, the Financial Intelligence Authority, the Personal Data Protection Office, and the Bank of Uganda.

9.2. We may disclose your account information and transaction records to authorities when required by law, court order, or regulatory directive, or when necessary to prevent or investigate fraud, money laundering, or other criminal activity.

9.3. Where permitted by law, we shall notify you if your information is disclosed to authorities, unless the disclosure order prohibits notification.

11. Changes to this policy

11.1. We may update this Policy from time to time. We shall notify you of material changes by email or through the Platform at least fourteen (14) days before the changes take effect.
